GRAM is a private, members-based platform providing access to cannabis products within a regulated, medical-use framework in South Africa.
By accessing this platform, you agree to these Terms and confirm that you meet the legal requirements for access.
1. Definitions
“GRAM” – the private platform and its operators
“Platform” – website and/or mobile application
“Products” – cannabis-related products made available via authorised channels
“Services” – facilitation of access and on-demand delivery
“Member” – an approved user
2. Acceptance of Terms
By creating an account, applying for membership, or using the Platform, you:
- confirm you have read and understood these Terms
- agree to be bound by them
- accept all related policies
These Terms form a binding agreement between you and GRAM.
3. Changes to Terms
We may update or amend these Terms from time to time in our discretion, for example to reflect changes in our business practices, Products, Services, or applicable law. When we make changes, we will publish the updated Terms on the Platform and update the “Last updated” date above.
Your continued membership, access to the Platform, or use of our Products or Services after any changes take effect will constitute your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Platform and our Products and Services and may cancel your membership in accordance with these Terms.
4. Eligibility and Capacity
To access GRAM, you must:
- be 18 years or older
- have legal capacity
- where applicable, hold a valid medical prescription
You confirm that:
- any information provided is accurate
- you are legally permitted to access cannabis
GRAM may request:
medical documentation (where required)
ID verification
We reserve the right to decline or cancel membership, refuse any order, or suspend access to the Platform or Services where we reasonably suspect that you do not meet these eligibility criteria, have breached these Terms, or where required by law.
5. Products and Services
GRAM operates as a private, members-only cannabis club. Access to our Products and Services is restricted to accepted members and may require a valid prescription from a registered medical practitioner. We do not sell Products to the general public.
Product descriptions, including strain information, potency, effects, and suggested use, are provided for information purposes only and do not constitute medical or professional advice. Cannabis affects individuals differently, and you use our Products at your own risk. If you have any medical conditions or take any medication, you should consult a medical professional before using cannabis products.
We may, at any time and without notice, change, suspend, or discontinue any Product or Service; limit the quantities of any Products offered; or impose additional conditions on certain Products or Services, subject to your rights under applicable consumer protection laws.
6. Pricing and Payment
All prices for Products, delivery, and membership fees (if applicable) will be displayed on the Platform or otherwise communicated to you. Prices are in South African Rand (ZAR) and include VAT where applicable, unless otherwise indicated.
If your payment is reversed, declined, or charged back, we may suspend or cancel your order and, if applicable, your membership, until full payment is received.
7. Orders and Delivery
Orders for Products can be placed via the Platform or as otherwise communicated by us. An order constitutes an offer to receive Products and is subject to acceptance by us. We may accept or reject an order in our discretion, for reasons including but not limited to stock availability, delivery constraints, verification concerns, or suspected misuse.
Risk and responsibility for the Products pass to you once delivery has been completed to the address you provided or to the person accepting delivery on your behalf.
8. Returns and Refunds
Due to the nature of cannabis products and applicable health and safety regulations, we are generally unable to accept returns of Products once they have been delivered and accepted, unless required by law (for example, in the case of defective or unsafe products).
9. Warranties and Disclaimers
To the maximum extent permitted by law, the Platform, Products, and Services are provided “as is” and “as available”, and we make no representations or warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, or that the Platform will be uninterrupted, secure, or error-free.
Nothing in these Terms is intended to limit or exclude any warranties or guarantees that cannot lawfully be limited or excluded, including those under the Consumer Protection Act, 68 of 2008, to the extent applicable.
10. Limitation of Liability
To the maximum extent permitted by law, GRAM, its owners, directors, employees, contractors, and affiliates will not be liable for any indirect, consequential, special, incidental, or punitive damages, or any loss of profit, revenue, business, data, or goodwill arising out of or in connection with these Terms, the Platform, the Products, or the Services, whether based on contract, delict (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims arising out of or in connection with these Terms, the Platform, the Products, or the Services will not exceed the total amount actually paid by you to us for the Products or Services giving rise to the claim during the 3 (three) months immediately preceding the event giving rise to the claim.
Nothing in these Terms will limit or exclude any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our gross negligence or willful misconduct, or for any other matter for which it would be unlawful to limit or exclude liability.

You agree to indemnify, defend, and hold harmless GRAM and its owners, directors, employees, contractors, and affiliates from and against any and all claims, demands, actions, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
12. Intellectual Property
All intellectual property rights in and to the Platform, including its design, layout, look and feel, text, graphics, logos, trademarks, trade names, content, and underlying software, are owned by or licensed to GRAM and are protected under applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use as a member, strictly in accordance with these Terms. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Platform or its content without our prior written consent.
13. Privacy and POPIA
We respect your privacy and are committed to protecting your personal information in accordance with POPIA and any other applicable data protection laws.
By applying for membership, using the Platform, or ordering or receiving Products or Services, you acknowledge that we will collect, use, store, and otherwise process your personal information for purposes including: processing your membership and orders; verifying your identity and age; delivering Products; managing your account; communicating with you; complying with legal obligations; and improving our Products and Services.
Our processing of personal information is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes in more detail what personal information we collect, how we use it, with whom we share it, and your rights in relation to your personal information.
14. Cookies
The Platform may use cookies and similar technologies to enhance your browsing experience, analyze usage, and assist with security and marketing. You can manage your cookie preferences through your browser settings or any cookie management tools we make available, but disabling certain cookies may affect the functionality of the Platform.
15. Third-Party Websites and Services
The Platform may contain links to or integrations with third-party websites, services, or content that are not owned or controlled by GRAM. We do not endorse, and are not responsible for, any third-party websites, services, or content, or for their availability, accuracy, or practices, including their privacy policies.
Your use of third-party websites or services is at your own risk and subject to the terms and conditions and privacy policies of those third parties.
16. Member Accounts and Security
To access certain features of the Platform and to place orders, you may need to create an account and maintain a membership profile. You agree to provide accurate, current, and complete information during registration and to keep your details up to date.
We reserve the right to suspend or terminate your account or membership, or to refuse any order, where we reasonably suspect unauthorized use, security breaches, or fraudulent activity.
17. User Conduct
You agree that you will use the Platform, Products, and Services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.
18. Platform Availability and Maintenance
We will use reasonable efforts to maintain the availability and performance of the Platform, but we do not guarantee that the Platform will always be available, uninterrupted, or error-free.
We may suspend or limit access to the Platform, or to certain features, for maintenance, upgrades, security reasons, or for any other operational reason, with or without prior notice. Where reasonably practicable, we will schedule maintenance outside of peak usage times.
19. Governing Law and Jurisdiction
These Terms, and any dispute, claim, or matter arising out of or in connection with them, the Platform, the Products, or the Services, will be governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to any conflict of law principles.
Subject to the dispute resolution provisions below, you agree that the courts of the Republic of South Africa will have jurisdiction over any dispute arising out of or in connection with these Terms, the Platform, the Products, or the Services.
20. Dispute Resolution
If any dispute arises between you and GRAM in relation to these Terms, the Platform, the Products, or the Services, the parties will first attempt to resolve the dispute informally, in good faith, through negotiation.
If the dispute is not resolved within a reasonable period (which will not be less than 15 Business Days) after written notice of the dispute is given, either party may refer the dispute to mediation or, failing that, to arbitration or to a competent court, as may be agreed between the parties or as otherwise provided by law.
21. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision will be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable. If such modification is not possible, the relevant provision will be deemed deleted, and the remaining provisions of these Terms will continue in full force and effect.
22. Entire Agreement
These Terms, together with any policies or documents incorporated by reference (including our Privacy Policy), constitute the entire agreement between you and GRAM in relation to their subject matter and supersede any prior or contemporaneous understandings, agreements, representations, or communications, whether written or oral, relating to the same subject matter.

24. Legal Disclaimer
Cannabis affects each person differently and may impair your ability to drive or operate machinery. Do not drive or operate heavy machinery under the influence of cannabis. Keep all Products out of reach of children and pets. Cannabis use may have health risks, particularly for persons with underlying medical conditions, mental health conditions, pregnant or breastfeeding persons, or persons taking certain medications. You are solely responsible for understanding and assuming all risks associated with the use of cannabis products.
Nothing on the Platform or in any of our communications or materials is intended to constitute medical, legal, or professional advice. You should consult an appropriate professional if you require advice in relation to cannabis use, medical conditions, or legal rights and obligations.
